DOWN PAYMENT: $5,000 down payment per parcel or $100,000 for all parcels to one single buyer immediately after the auction and with balance in cash at closing. The down payment may be in the form of cash, cashiers check, personal check or corporate check. YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING, SO BE SURE YOU HAVE ARRANGED FINANCING, IF NEEDED, AND ARE CAPABLE OF PAYING CASH AT CLOSING.

DECLARANT RIGHTS: Any single buyer of ALL available lots will be granted declarant rights for the subdivision. 

OTHER FEES: Buyer is responsible for $200 HOA transfer fee per parcel to be paid at closing (waived for single buyer of all lots) and $3500 FWCD transfer/tap fee per parcel due at closing. Please note that certain lots contain multiple parcels. Variances and/or waivers of transfer/tap fees provided at the Falling Waters Conservation District's discretion and approval. BUYER`S PREMIUM: A buyer's premium of 10% will be added to the final bid price of the property.

APPROVAL OF BID PRICES: All successful bidders will be required to enter into purchase agreements at the auction site immediately following the close of the auction. All final bid prices are subject to the Sellers acceptance or rejection.

DEED: Seller shall provide a special warranty deed.

EVIDENCE OF TITLE: Seller shall provide title insurance in the amount of the purchase price.

CLOSING: Closing shall take place in 30 days,

POSSESSION: At closing.

REAL ESTATE TAXES: Taxes are pro-rated and final at day of closing

ACREAGE: All acreage is approximate and has been estimated based on current legal descriptions and/or aerial photos.

SURVEY: There shall be no survey

EASEMENTS: The sale of the property is subject to any and all easements of record.
